RealPage Reaches Settlement with State of Nevada Regarding Revenue Management Software

RealPage, a global provider of AI-enabled software platforms for the real estate industry, has finalized a settlement and consent judgment with the State of Nevada concerning the use of its revenue management software within the state. The company stated its satisfaction with the resolution, noting it provides clarity for software use in Nevada while enabling the continued offering of its solutions to the rental housing ecosystem.

RealPage denies the allegations made by the Nevada Attorney General and reached this resolution to prevent the expenses and disruptions of potential litigation. The company maintains that its solutions are legally compliant and can be configured as laws or interpretations evolve. RealPage’s revenue management software has undergone reviews by antitrust counsel over time and, in 2017, by the U.

S. Department of Justice without objection.

Following increases in rental prices, home prices, and other consumer goods, attributed to supply shortages and factors related to the COVID-19 pandemic, housing affordability became a focus for politicians and regulators. RealPage, which states it has always used data responsibly and in a pro-competitive, legally compliant manner, previously modified its revenue management software. This modification removed nonpublic data from unaffiliated properties from the calculation of rent recommendations for all customer properties, in response to legislative activity.

The proposed consent judgment outlines specific terms. It includes no admission of wrongdoing or liability by RealPage and a full release of all Nevada Attorney General claims related to allegations concerning its revenue management products.

Regarding the use of nonpublic data, RealPage may now use nonpublic data from other unaffiliated properties in the runtime operation of its revenue management software to calculate rent recommendations for Nevada properties under specific conditions: the data must be aged at least three months, anonymized, and aggregated to at least ten properties. Similarly, RealPage may publish nonpublic data concerning rent, occupancy, or availability to its Nevada customers only if such data is aggregated to at least ten properties and anonymized. Furthermore, RealPage revenue management software may utilize machine learning models trained with nonpublic data from Nevada properties only if that data is aged at least three months, without limiting affiliated properties’ use of their own data.

As part of the settlement, RealPage will contribute $200,000 to the State of Nevada. This sum is designated for distribution to one or more Nevada-based nonprofit or governmental organizations that provide down payment assistance or rent reduction to Nevada residents. The company also committed to providing annual certifications of compliance to Nevada for a five-year term and will maintain an antitrust compliance program that includes training for revenue management personnel.
